Overview
Canadian immigration laws allow a family person to sponsor family members with a purpose to reunite family members once again in Canada with a status of permanent residence to the sponsored member.

People in Canada have a right to practice to their own religion, dress as culture allows, speak as you please with certain limits, and many more rights to make it easier for people to comfort with Canadian environment.

 

Sponsorship: Spouse, Common-law partner, Conjugal partner

Spouse, Common-law partner, the Conjugal partner may be sponsored under family sponsorship class. All above-mentioned partners are with the same, and the opposite sex are allowed in Canada, the relationship between the same and the opposite sex is valid in Canada.

 

Sponsorship under family class for an above-mentioned partner can be processed in two ways as followed below, provided eligibility and other requirements are met by applicable parties.

 

In Canada Class

An application of sponsorship, where the sponsored individual is residing in Canada and wish to continue to reside in Canada while the application is in process.

The sponsored candidate who is applicable may apply for an open work permit or study permit.

 

Important note:

In the event of a negative decision from Immigration, Refugee and Citizenship Canada (IRCC), applicant(s) who apply under this category do not have an appeal right at Immigration and Refugee Board of Canada (IRB).

 

However, in the above situation, applicant(s) may seek options with the Federal Court of Canada.

 

 

Family Class

An application of sponsorship, where the sponsored individual is not residing Canada while the application is in process.

 

Important notes:
In the event of a negative decision from Immigration, Refugee and Citizenship Canada (IRCC), applicant(s) who apply under this category do have an appeal right at Immigration and Refugee Board of Canada (IRB).

 

Furthermore, in the above situation, applicant(s) may seek options with the Federal Court of Canada if the situation is not resolved in favor of applicant(s) at Immigration and Refugee Board of Canada (IRB).

Requirements

Requirements for Sponsorship:

Sponsor

  • Must be at least 18 years old Canadian Citizen or Permanent resident of Canada or a person registered in Canada as an Indian under the Canadian Indian Act.
  • Canadian Citizen living abroad may sponsor spouse but must be present in Canada on arrival of sponsored spouse; Permanent resident must be living inside Canada to sponsor a spouse.
  • The sponsor must able to provide for the basic needs of him/herself and sponsored spouse. In the event of sponsoring a spouse, or a common-law partner, or a conjugal partner LICO is not required. However, LICO is required in the situation of where a dependent child of a sponsored spouse has a child.
  • Sponsor individual must not be in prison, under a removal order if he/she is PR and charged with a criminal offense for pardon is not granted and must not charge with a sexual
  • Sponsor individual must sign an undertaking (a promise to minister by the sponsor to provide basics need to sponsored spouse), Undertaking duration is 3 years for Spouse, Common-law partner, conjugal partner and 3 to 10 years for dependent
  • Sponsor individual must not be sponsored as a spouse in the last five years.

 

 

The sponsor cannot act as a sponsor if

 

  • Sponsor has outstanding immigration loan amount, did not pay a performance bond, did not back any family support payments and other applicable aspects.

 

  • Sponsor failed to obligate previous undertaking.

 

  • Sponsor is under removal order, in jail, in penitentiary.

 

  • Sponsor receive social assistance from government other than the reason of disability.

 

  • Sponsor has filed bankruptcy and has not been discharged yet.

 

  • Sponsor individual sponsored the previous partner in last three immediate years.

 

  • Sponsor individual was previously sponsored as a spouse in the last five years.

 

  • Sponsor individual was involved in the sexual offense, caused or attempted harm to a relative.

 

  • Sponsor’s current application of sponsoring spouse/partner is in process.

 

 

Sponsored:

  • A spouse, Common-Law partner or conjugal partner: Must be at least of 18 years old to be sponsored and marriage between couple must be valid within foreign jurisdiction if took place outside Canada and applicant(s) shall have a marriage certificate. The license of marriage is not acceptable by IRCC as a marriage proof.
  • Dependent children of your sponsored spouse: As of October 24, 2017: Child under 22 is considered Dependent, and Over 22 may also be considered as a dependent child if the child was depended on parents before 22 and is not able to support him/herself financially due to mental or physical condition.

Note:

  • If your spouse has some medical condition with excessive demand still spouse may still be able to immigrate in Canada provided spouse to meet all other requirements.

 

  • A sponsored person shall not have charged with criminal conviction(s).

 

  • Sponsor is financially responsible for sponsored for 3 years from the day of sponsored spouse landing in Canada. If a Sponsored person receives any government support to survive then sponsor is obligated to pay back to the government.
